Terms and Conditions



1. Our quality

All products offered have passed our strict quality inspections. If unexpected problems arise, you not only have the statutory quality warranty of two years; an additional voluntary manufacturers’ guarantee may apply. Please retain your invoice or the delivery note and if available the manufacturers’ warranty card.If you have any queries or complaints, contact our customer service office under +41 (0)848 85 3333* in Switzerland. 2. Your right to return



You may return any goods purchased via mail order or from SWISS SHOP without stating a reason within 14 days of receiving the goods, preferably in the original packaging. You may choose between replacement of the goods or reimbursement of the price. From Switzerland, goods should be returned to: SWISS SHOP, Schweizer Versandzentrum AG, Blumattstrasse 7, CH-6161 Entlebuch, unless otherwise stated on the return delivery label. When returning goods from outside Switzerland, it is sufficient to send your request for return to the following address within the specified time limit: SWISS SHOP, P.O. Box, CH-8058 Zurich-Airport or via e-mail to swiss_shop@shop.swiss.com. We shall be entitled to claim compensation if goods are returned which have been damaged or used (which goes beyond fitting respectively examining, as is possible in shops). The right of return shall not apply to newspapers, magazines, or to audio or video recordings (e.g. CDs, video cassettes, DVDs) and software if the seal has been broken. Returns shall also be excluded for services rendered at a specified time in the areas of accommodation, transport or goods that are unsuitable for returning or that can spoil quickly or whose expiry date is overdue, as well as recreational activities. The same applies to financial services inasmuch as their value on the financial market is subject to fluctuations (e.g. in the case of stocks) which are outside the influence of the provider.



3. Conclusion of the contract

After placing an order with SWISS SHOP, you will receive an order confirmation via e-mail if you have provided an e-mail address. This confirmation acts as confirmation of receipt and does not constitute a legally binding acceptance of your order. The contract is concluded between you and Lufthansa WorldShop GmbH, branch Kloten, as operator of SWISS SHOP when your order is accepted by shipping the goods. All goods remain property of Lufthansa WorldShop GmbH, branch Kloten, until paid for in full.Our prices naturally include value-added tax at the statutory rate (as applicable in January 2007; subject to change).Due to permanent improvements in product quality, the actual product may occasionally differ from that illustrated and / or specified. All stated performances, dimensions, weights and sizes are approximate. We cannot accept any liability for errors (which hopefully will not occur), unless they are caused by gross negligence or intent by Lufthansa WorldShop GmbH, branch Kloten.



4. Our delivery times and capability, shipping cost

Goods are delivered circa one week after receiving your order. Delivery is made on workdays. If delivery is made by a forwarding agent, goods are delivered circa 2 to 6 weeks after receipt of the order. The delivery date is arranged between the consignee and the forwarding company.For delivery within Switzerland shipping costs of CHF 7.50 apply.For delivery to AT, BE, BG, CY, CZ, DE, DK, EE, ES, FI, FR, GR, HU, IE, IT, LT, LU, LV, MT NL, PL, PT, RO, SE, SI, SK, UK we charge CHF 29.-. Customs duties and charges for delivery to the Canary Islands must be paid by the consignee.The minimum order value is CHF 50.-.If a vintage wine or sparkling wine is sold out, SWISS SHOP will deliver a product of equivalent quality. Your statutory right to return goods is, of course, not affected.



5. Payment for purchases in Swiss Francs

You can pay by credit card or by invoice (only possible in Switzerland for SWISS Frequent Travellers, Senators, HON Circle Members and SWISS SHOP customers with customer number). Invoices are payable without deduction within 14 days. Simply state your preferred method of payment when ordering. Please note that goods delivered outside Switzerland can only be paid for by credit card.



6. Miles & More awards

For the redemption of award miles for flight-, upgrade-, travel-, adventure- and merchandise awards, the Miles & More conditions apply in addition to the general terms and conditions of SWISS SHOP. When redeeming miles, a minimum of 7,500 miles must be used.An additional 1,000 miles are deducted as a flat rate for handling and shipping within Switzerland. For delivery to AT, BE, BG, CY, CZ, DE, DK, EE, ES, FI, FR, GR, HU, IE, IT, LT, LU, LV, MT NL, PL, PT, RO, SE, SI, SK, UK a surcharge of 7,000 miles applies. Customs duties and charges for delivery to the Canary Islands must be paid by the consignee.On demand we will charge shipping costs in Swiss Francs, as regulated in paragraphs 4 and 5.



7. Combined miles redemption and payment with CHF

If an article is tagged with both miles and a price in CHF, it can be purchased by redeeming miles and additional payment in CHF. The following conditions apply: The order of an award requires a minimum redemption of 7,500 miles and shipping costs must be paid in CHF, as regulated in paragraphs 4 and 5. Furthermore, the Miles & More conditions apply.



8. Miles & Travel, Miles & Event and ProTrain seminars

All Travel and Event offers and the ProTrain seminars are operated by independent (travel) partners. Your reservation inquiry will be forwarded to the respective travel partner. 9. Travelling with luggage

The dimensions of the SWISS carry-on luggage indicated are applicable in January 2007 and may differ from other airlines’ standards. It is therefore advisable to contact the respective airline before your flight. Check your luggage as soon as it comes off the luggage belt after each flight. If it is damaged, you should file a verbal and written complaint with the airline and / or transport company immediately, preferably before clearing customs. Further information on luggage insurance can be obtained from every travel agent.



10. Data protection

The handling of personal data (names, postal addresses, telephone and / or credit card numbers) which the customer discloses to Lufthansa WorldShop GmbH, branch Kloten, as operator of SWISS SHOP in the line of order fulfilment is liable to data protection laws. When placing an order, the customer agrees that his personal data is being stored in a machine-readable way and can be processed for order fulfilment. The transmission of this personal data to a third party without consent of the customer is not permitted. The customer explicitly agrees to the transmission of data to a third party in the line of order fulfilment, particularly for the performance of credit checks. A third party handling personal data for Lufthansa WorldShop GmbH, branch Kloten, for order fulfilment also has to diligently protect this data.



11. Applicable law and place of jurisdiction

Swiss law applies, with exclusion of the UN Convention on the International Sale of Goods. Kloten shall be the exclusive place of jurisdiction for bilateral commercial sales.



Lufthansa WorldShop GmbH is a limited liability company under German law with headquarters at D-60549 Frankfurt, Main Airport Center, Unterschweinstiege 8. It is registered in the Register of Companies of Frankfurt am Main local court under number HRB 76808 and is represented by its managing director Mr. Peter Pullem. Its branch, Lufthansa WorldShop GmbH, Frankfurt a.M., branch Kloten, with registered office Kloten, is registered in the Register of Companies of canton Zurich under number CH-020.9.002.582-2.
